Common use of Subcontractors and Agents Clause in Contracts

Subcontractors and Agents. Business Associate will require any of its subcontractors and agents, to which Business Associate is permitted by this Agreement or in writing by Company to disclose PHI and electronic PHI, to provide reasonable assurance, evidenced by written contract, that such subcontractor or agent will comply with the same privacy and security obligations as Business Associate with respect to such PHI and, electronic PHI.

Subcontractors and Agents. The Business Associate will shall require any each of its subcontractors and agentsor agents to which the Business Associate provides PHI received from, or created or received by the Business Associate on behalf of the Covered Entity, to which Business Associate is permitted by this Agreement or in writing by Company to disclose PHI and electronic PHI, to provide reasonable assurance, evidenced by written contract, that such subcontractor or agent will comply with the same privacy restrictions and security obligations as conditions that apply through this BAA to the Business Associate with respect to such PHI and, electronic PHIinformation.

Subcontractors and Agents. Business Associate will shall require any each of its subcontractors and agents, or agents to which whom Business Associate is permitted may provide PHI or Health Information received from or on behalf of EMS Agency or who otherwise create, receive, maintain, or transmit PHI on behalf of Business Associate to agree to the same restrictions, conditions and requirements to protect such PHI as are imposed on Business Associate by this Agreement or in writing by Company to disclose PHI and electronic PHI, to provide reasonable assurance, evidenced by written contract, that such subcontractor or agent will comply with the same privacy and security obligations as Business Associate with respect to such PHI and, electronic PHIAddendum.

Business Associate will shall require any each of its subcontractors and agents, or agents to which whom Business Associate is permitted may provide PHI on behalf of the Plan to agree to written contractual provisions that impose at least the same obligations to protect such PHI as are imposed on Business Associate by this Agreement or in writing by Company and the Privacy and Security Regulations. Business Associate shall maintain a list of all subcontractors and agents to disclose PHI and electronic which it provides the Plan's PHI, and it will provide the list to provide reasonable assurance, evidenced by written contract, that such subcontractor or agent will comply with the same privacy and security obligations as Business Associate with respect to such PHI and, electronic PHIPlan upon request.

Business Associate will shall require any each of its subcontractors and agents, or agents to which whom Business Associate is permitted may provide PHI received from, or created or received by this Agreement or in writing by Company Business Associate on behalf of Health Plan to disclose PHI and electronic PHI, agree to provide reasonable assurance, evidenced by written contract, contractual provisions that such subcontractor or agent will comply with impose at least the same privacy and security obligations to protect such PHI as are imposed on Business Associate with respect to such PHI and, electronic PHIby the Contract.

Business Associate will shall require any of its and all subcontractors and agents, or agents to which whom Business Associate is permitted by this Agreement or in writing by Company provides PHI to disclose PHI and electronic PHI, agree to provide reasonable assurance, evidenced by written contract, that such subcontractor or agent will comply with impose at least the same privacy and security obligations to protect such PHI as are imposed on Business Associate with respect to such PHI and, electronic PHIby the Agreement and this Addendum.
