Common use of Subcontractors and Agents Clause in Contracts

Subcontractors and Agents. Business Associate agrees to ensure that any agent, including any subcontractor, to whom it provides protected health information received from, or created by Business Associate on behalf of Covered Entity agrees in writing to the same terms, conditions and restrictions on the use and disclosure of protected health information as contained in this Contract.

Subcontractors and Agents. Business Associate agrees to will ensure that any agent, including any a subcontractor, to whom it provides protected health information received fromthat creates, receives, maintains, or created by Business Associate transmits Protected Health Information on behalf of Covered Entity the Business Associate agrees in writing to: • The same restrictions and conditions that apply to the same terms, conditions and restrictions on the use and disclosure of protected health information as contained Business Associate in this ContractBAA to such Protected Health Information; and • Implement reasonable and appropriate safeguards to protect the Electronic Protected Health Information.

Ensure that any agent, including any subcontractor, agents and subcontractors to whom it Business Associate provides protected health information received fromProtected Health Information that Business Associate has created, stored, accessed, received, maintained, or created by Business Associate transmitted on behalf of Covered Entity agrees in writing Entity, agree to the same terms, restrictions and conditions and restrictions on the use and disclosure of protected health information as contained that apply to Business Associate in this ContractAgreement; and ii. Notify Covered Entity in writing of any such agents and subcontractors to whom Business Associate discloses or otherwise provides such Protected Health Information.

Business Associate agrees will use commercially reasonable efforts to ensure that any agent, including any a subcontractor, to whom it Business Associate provides protected health information Protected Health Information, created or received from, or created by Business Associate on behalf of Covered Entity Entity, agrees in writing (or has agreed) to: i. The same restrictions and conditions that apply to the same terms, conditions and restrictions on the use and disclosure of protected health information as contained Business Associate in this ContractAgreement to such Protected Health Information; and ii. Implement reasonable and appropriate safeguards to protect the Electronic Protected Health Information.
