Common use of Substitution of Indexes Clause in Contracts

Substitution of Indexes. In the event that: (i) the U.S. Department of Labor substantially revises the methodology of calculation of any of the indexes referred to above, or (ii) the U.S. Department of Labor discontinues, either temporarily or permanently, any of the indexes referred to above, or ***** Confidential portions of the material have been omitted and filed separately with the Securities and Exchange Commission. (▇▇▇) the data samples used to calculate any of the indexes referred to above are substantially changed, then Lessor shall select a substitute index; then a substitute index shall be used. Such substitute index shall reflect as closely as possible the actual variations of the wages or of the material costs, as the case may be, used in the calculation of the original index. As a result of this selection of a substitute index, Lessor shall make an appropriate adjustment to its price revision formula, allowing to combine the successive utilisation of the original index and of the substitute index.
