Summary Description. Subject to the satisfaction or waiver of the Seller’s Conditions Precedent, Seller shall construct, own, operate, and maintain the Facility and associated equipment having an actual maximum net generating nameplate capacity rating, measured in MWac, of up to the Expected Facility Capacity.
