The 'Suspension at User's Request' clause allows the user to temporarily halt the performance of services or delivery of goods under a contract. Suspension at User's Request. Temporary Disconnection (a) The User may request ActewAGL to stop or suspend the delivery of Gas to one or more Delivery Points (other than to a Small Volume Customer Delivery Point) on payment of the relevant Ancillary Charge by the User and subject to the User having first complied with all obligations placed on the User under relevant Gas Law relating to arranging for the suspension of Gas to each of those Delivery Points. (b) ActewAGL must at the later of: (i) the earliest reasonably practical date after receipt of notice from the User; and (ii) the date requested by the User, stop or suspend the delivery of Gas to each Delivery Point nominated in a notice duly issued under clause 22.1(a), unless ActewAGL considers relevant Gas Law relating to the disconnection of premises served by a Delivery Point have not been met. Any such stoppage or suspension will not relieve the User from its obligations under this Agreement to pay for the relevant Service if ActewAGL is able to provide it to that Delivery Point. (c) If requested by ▇▇▇▇▇▇▇▇, a representative of the User must be present when ActewAGL stops or suspends the delivery of Gas to the Delivery Point. (d) ActewAGL is entitled to charge the User the applicable Ancillary Charge for costs reasonably incurred by ActewAGL for stopping or suspending the delivery of Gas at the User's request.

(b) If requested by the Service Provider, a representative of the User must be present when the Service Provider stops or suspends the delivery of Gas to the Delivery Point. (c) The Service Provider is entitled to charge the User the applicable Ancillary Fee for costs reasonably incurred by the Service Provider for stopping or suspending the delivery of Gas at the User's request.
Suspension at User's Request. The inclusion of this sub-clause 24.1(c) does not appear to be necessary as this is provided for in Clause 20. Clause 24.2 has been amended to no longer relate to acts of the particular User. It no longer operates under the precondition that the User has not, for example, delivered sufficient gas to the Receipt Point to meet a User’s withdrawal requirements. For example, it operates where the Service Provider receives Out-of Specification Gas from another User. The proposed amendments do not appear reasonable and do not associate cause with effect.

  • Termination for continuing Force Majeure Event Either Party may, by written notice to the other, terminate this Framework Agreement if a Force Majeure Event endures for a continuous period of more than one hundred and twenty (120) Working Days.

  • Default Notice As soon as possible and in any event within two days after the occurrence of each Default or any event, development or occurrence reasonably likely to have a Material Adverse Effect continuing on the date of such statement, a statement of the chief financial officer of the Borrower setting forth details of such Default and the action that the Borrower has taken and proposes to take with respect thereto.

  • Justification for the Request The request for a supplemental funding for any of the above-mentioned programs should contain a justification clearly documenting the need for the additional funding authority during the current quarter. This documentation should be in the form of State accounting records or similar documents that will show the actual expenditures through the most recent month for which such data are available, as well as the State's most accurate projection of its anticipated expenditures during the remaining month(s) of the quarter. For either the TANF or the CCDF program, the State's justification should also include an explanation of the activities requiring the obligation and/or expenditure of amounts that exceed the normal quarterly grant award restrictions and why these activities could not have been delayed until the next quarter.
