Common use of Swap Counterparty Clause in Contracts

Swap Counterparty. The Swap Counterparty shall be a third party beneficiary of the terms and provisions of this Agreement and the other Repurchase Documents. Notwithstanding anything contained herein to the contrary, all representations, warranties, duties and covenants of the Seller and the Guarantor to or for the benefit of the Purchaser shall also be to and for the benefit of the Swap Counterparty, regardless of whether the same is expressly stated in each instance.
