The Switch Version clause establishes the right or process for changing from one version of a product, service, or agreement to another. Typically, this clause outlines the conditions under which a party may upgrade, downgrade, or otherwise alter the version they are using, such as software releases or subscription tiers, and may specify notice requirements or any associated costs. Its core practical function is to provide flexibility and clarity for both parties, ensuring that transitions between versions are managed smoothly and with mutual understanding.

  • Data Encryption Contractor must encrypt all State data at rest and in transit, in compliance with FIPS Publication 140-2 or applicable law, regulation or rule, whichever is a higher standard. All encryption keys must be unique to State data. Contractor will secure and protect all encryption keys to State data.
