Common use of System Construction Clause in Contracts

System Construction. (1) New construction timetable. (a) Within two (2) years from the date of the award of the initial franchise, the Grantee must make cable television service available to every dwelling unit within the initial service area. (1) The Grantee must make cable television service available to at least twenty (20) percent of the dwelling units within the initial service area within six (6) months from the date of the award of the franchise. (2) The Grantee must make cable television service available to at least fifty (50) percent of the dwelling units within the initial service area within one (1) year from the date or the award of the franchise. (b) The Grantee, in its application if any, may propose a timetable of construction which will make cable television service available in the initial service area sooner than the above minimum requirements, in which case the said schedule will be made part of the franchise agreement, and will be binding upon the Grantee. (c) Any delay beyond the terms of this timetable, unless specifically approved by the Village, will be considered a violation of this chapter for which the provisions of either Sections 37 or 46 shall apply, as determined by the Village. (d) In special circumstances the Village can waive one hundred (100) percent completion within the two (2) year time frame provided substantial completion is accomplished within allotted time frame, substantial completion construed to be not less than ninety-five (95) percent and justification for less than one hundred (100) percent must be submitted subject to the satisfaction of the Village.

(c3) Any delay beyond the terms of this timetable, unless specifically approved by the Villagevillage, will be considered a violation of this chapter article for which the provisions of either Sections 37 section 48-65 or 46 48-75 shall apply, as determined by the Villagevillage. (d4) In special circumstances the Village village can waive one hundred (100) 100 percent completion within the two (2) two-year time frame timeframe provided substantial completion is accomplished within the allotted time frametimeframe, substantial completion construed to be not less than ninety-five (95) 95 percent and justification for less than one hundred (100) 100 percent must be submitted subject to the satisfaction of the Villagevillage.
