System Warranty. During the entire Power Purchase Agreement Term, under normal use and service conditions, the System will be free from defects in workmanship or defects in, or a breakdown of, materials or components (the “System Warranty”);
System Warranty. The Contractor represents and warrants that the system and software delivered under the Contract shall be free from defect and capable of performing the Contract services when operated by the Department. The Contractor agrees to correct errors discovered in the design and installation of the software not due to the fault or negligence of the Department. Any enhancement or other changes that may be undertaken during the performance of the Contract will be covered by this warranty. The Contractor represents and warrants that no “anti-use” devises have been or will be installed in the software. The “anti-use” warranty shall survive termination of the Contract.

System Warranty. The Vendor warrants that, for a period ending three (3) years from the Final Acceptance of the last PCS System within the Initial System (the "System Warranty Period"), the ongoing performance of each PCS System together with all other PCS Systems and PCS Sub-Systems within the System will conform with and perform to the performance criteria set forth on Exhibit F as of the date of the Final Acceptance of such PCS System based on the circumstances within such PCS System on such date. The System warranty pursuant to this subsection 17.3 will be limited to the extent that the projections of subscriber growth, traffic and other predictive data, including all applicable standards as identified in Exhibits B1, D and H, upon which the Final Site Count and Final RF Design have been determined, have not been materially exceeded or the applicable and relevant industry standards have not materially changed.

System Warranty. (i) Warranty Statement Acer warrants the Acer hardware products (excluding Expendable parts) described in this Warranty Booklet that are purchased from Acer or an Authorized Vendor* in the Middle East Region, against defects in materials or workmanship under normal use for the warranty periods defined in the Warranty Card. It is the responsibility of the customers to refuse to accept delivery of any Acer product sold as new when the Acer security seal is broken and notify the seller accordingly. By accepting an Acer product with a broken seal, the customer acknowledges the warranty entitlement of such unit will be different (reduced) vs. the standard Terms and Conditions associated to a sale of a new Acer product. Details of the warranty are set forth in the remaining sections. CONSUMERS HAVE LEGAL RIGHTS UNDER APPLICABLE NATIONAL LEGISLATION GOVERNING THE SALE OF CONSUMER GOODS AND THIS WARRANTY DOES NOT EXCLUDE, LIMIT OR SUSPEND ANY SUCH APPLICABLE RIGHTS (ii) Warranty Period The warranty period commences on the date of purchase. (iii) Warranty Identification The sales receipt or your purchase invoice showing the date of purchase of Acer Product and duly filled Warranty Instructions, showing the serial number and date of purchase of Acer Product, is the proof of the date of purchase. This Limited Warranty extends beyond the original purchaser to any lawful successor in interest, provided, however, that anyone claiming under this warranty must, upon request, produce the original purchase invoice to be entitled to warranty services. (iv) Service Scope Within the warranty period, Acer Authorised Service Provider (AASP) will perform repair or replacement of defects in workmanship or parts covered by this warranty in the region of Middle East.
System Warranty. IM warrants for a period of [*] from [*] of any Wets Workflow sold hereunder, and during any additional period during which ATMI renews, under the terms of this Agreement, its HPC Site License and HPC-Enabled Informatics Software license and Maintenance and Support for each Wets Workflow item, the Informatics Software for each Wets Workflow item, and the Informatics Hardware (such additional renewal periods must be continuous from the initial [*] term), that (i) the Wets Workflow items are compatible and will operate with one another as set forth in the Purchase Documentation, and (ii) the Wets Workflow will support the applications as set forth in Exhibit D. This warranty is in addition to IM’s other applicable warranties. IM does not otherwise warrant the Wets Workflow and does not warrant that its operation will be uninterrupted or error free. If the Wets Workflow does not meet the warranty specified above during the warranty period, IM shall, at its option, repair or replace at no cost to ATMI the nonconformity. Procedures and response times in connection with warranty claims under this Section 8.6, as well as IM’s obligations with respect to maintenance and support, are set forth in Exhibit C for the Equipment, Informatics Hardware and Informatics Software, provided that IM will promptly remedy any such nonconformity in 8.6(ii) above.
System Warranty. Sabre warrants that during the term of this Agreement the System will operate to provide access to the Sabre System during Normal Business Hours, provided that (1) the System may not be operable during brief periods due to routine maintenance, (2) Customer has Installed or permitted installation of all required upgrades to any software or hardware, including any Customer owned equipment or software, and (3) the failure of the System to operate is not caused by Customer.
System Warranty. When all tests are successfully completed, the District shall furnish, at Contractor’s request, a letter of verification for the tests. The Contractor shall assume responsibility for all defects in material and workmanship of the water/wastewater system for a period of one year beginning on the date the tests are successfully performed. If the Contractor is unable or unwilling to correct defects occurring within that warranty period, the Developer shall assume responsibility for correction.
System Warranty. Illuminate warrants to District that the System as delivered, will materially comply with the published specifications of Illuminate for such System. Illuminate does not warrant that the operation of the System will be uninterrupted or error-free. IN PARTICULAR, FOR PURPOSES OF THE FOREGOING WARRANTY, ILLUMINATE AND DISTRICT ACKNOWLEDGE THAT THE SYSTEM IS NOT AND CANNOT BE MADE TO BE 100% ACCURATE, AND THAT ANY ERRORS OR FAILURE TO PERFORM SHALL NOT BE DEEMED A BREACH OF SUCH WARRANTY UNLESS THEY ARE SIGNIFICANT AND NOT TO BE EXPECTED IN LIGHT OF THE LIMITATIONS OF SYSTEMS OF THIS TYPE.
