Technical Advisor. The Relevant Obligors shall:
(a) appoint (under a deed of appointment or appointment agreement in the agreed form) the Technical Advisor, prior to the levying of any fine referred to in paragraph 13 of Schedule 9 (Events of Default), such appointment not to expire or otherwise terminate until after the practical completion of the City of Dreams Site (including the Additional Hotel);
(b) promptly provide the Technical Advisor with all information that may be required for it to issue the report contemplated by sub-paragraph (d) of paragraph 13 of Schedule 9 (Events of Default); and
(c) following the appointment of the Technical Advisor, shall procure that the Technical Advisor also provides to the Lenders an update in the agreed form (no less frequently than once every 3 Months until the practical completion of the Additional Hotel) in respect of the progress of the completion of the development of the City of Dreams Site (including the Additional Hotel).

Technical Advisor. If the Contract Particulars provide that a Technical Advisor's Certification is required in relation to the Site then the Commonwealth will appoint the Technical Advisor to carry out the functions of the Technical Advisor. The Commonwealth may, in its absolute discretion, terminate the services of the Technical Advisor and: the Commonwealth's decision to terminate the services of the Technical Advisor is final and conclusive; the Commonwealth is not under any obligation to give the Contractor any reason or explanation for its decision to terminate the Technical Advisor; the Contractor acknowledges that it is not entitled to, and agrees that it will not seek to, restrain or otherwise intervene in or interfere with the termination of the services of the Technical Advisor; and the Contractor acknowledges that it will not be entitled to make any Claim against the Commonwealth arising out of, or in connection with, the termination of the Technical Advisor's services. If the Commonwealth terminates the services of the Technical Advisor, or if the Technical Advisor ceases to act for any reason, the Contract Administrator will: promptly notify the Contractor in writing; and as soon as reasonably practicable, appoint another Technical Advisor and notify the Contractor of that appointment. Any Technical Advisor appointed under subparagraph 3.10(e)(ii) is bound by any direction given by any former Technical Advisor to the same extent as the relevant former Technical Advisor would have been bound by that direction.
