Telephone Service. This section applies only to those customers who subscribe to Telephone Services from Ziply Fiber. i) You agree that Ziply Fiber will not be responsible for any losses or damages arising as a result of the unavailability of the Telephone Service or the inability to contact your home security system, fire alarm system or remote medical monitoring service provider. You acknowledge that Ziply Fiber does not guarantee that Telephone Service will operate with your home security, fire alarm and/or medical monitoring systems, and that you must contact your service provider in order to test your system’s operation with the Telephone Service. You agree that a service outage due to a suspension of your account as a result of billing or other issues will prevent ALL services from being provided to you, including any 911 emergency response services. ii) You acknowledge that the existing telephone wiring inside your home may not support both Telephone Service and digital subscriber line service (“DSL”) internet service. If you intend to use Telephone Service on all of your phone jacks, you may be required to maintain separate wiring, not provided by Ziply Fiber, within your home specifically for DSL or to disconnect your DSL prior to receiving Telephone Service over your existing in-home wiring. iii) YOU AGREE AND UNDERSTAND THAT ZIPLY FIBER WILL NOT BE LIABLE FOR ANY TELEPHONE SERVICE OUTAGE, INABILITY TO DIAL 911 USING THE TELEPHONE SERVICE, AND/OR INABILITY TO ACCESS EMERGENCY SERVICE PERSONNEL DUE TO THE 911/E911 FEATURE. YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS ZIPLY FIBER, ITS OFFICERS DIRECTORS, EMPLOYEES, AFFILIATES AND AGENTS, AND ANY OTHER PROVIDER WHO FURNISHES SERVICE TO YOU IN CONNECTION WITH THE TELEPHONE SERVICE, FROM ANY AND ALL CLAIMS, LOSSES, DAMAGES, FINES, PENALTIES, COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO REASONABLE ATTORNEYS’ FEES) BY, OR ON BEHALF OF, ANY THIRD PARTY OR USER OF TELEPHONE SERVICE RELATING TO THE FAILURE, OUTAGE OR MALFUNCTION OF THE TELEPHONE SERVICE, INCLUDING THOSE RELATED TO 911/E911 OF THE FAILURE, OUTAGE OR MALFUNCTION OF THE ZIPLY FIBER EQUIPMENT OR FACILITIES.

Telephone Service. This section applies only THAMES VALLEY COMMUNICATIONS (TVC) TELEPHONE SERVICE WILL BE PROVIDED TO YOU OVER THE BROADBAND INTERNET SERVICE TO YOUR HOME. TVC WILL PROVIDE A TELEPHONE ADAPTER THAT WILL CONNECT YOUR TELEPHONE (S) TO YOUR CABLE MODEM IN ORDER TO PROVIDE YOU WITH HIGH QUALITY TELEPHONE SERVICE AT YOUR HOME (THE “SERVICE”). THE TELEPHONE ADAPTER THAT IS PROVIDED TO YOU IS DESIGNATED EXCLUSIVELY FOR USE IN YOUR HOME. USE FROM ANY OTHER LOCATION IS STRICTLY PROHIBITED AND MAY INTERFERE WITH RECEIPT OF EMERGENCY SERVICES. ACCORDINGLY, TVC WILL NOT BE HELD LIABLE, IN ANY WAY, IN THE EVENT THAT YOU ATTEMPT TO USE YOUR TELEPHONE ADAPTER TO SUMMON EMERGENCY SERVICES FROM ANY LOCATION OTHER THAN YOUR HOME. TVC WILL NOT BE HELD LIABLE FOR ANY DAMAGES, INJURIES OR LOSS OF LIFE RESULTING FROM, OR EXACERBATED BY AN INABILITY TO REACH EMERGENCY SERVICES PERSONEL, OR BY EMERGENCY SERVICES PERSONEL BEING DELAYED OR UNABLE TO LOCATE YOU IN THE EVENT THAT YOU DIAL 911 VIA A TELEPHONE ADAPTER THAT IS BEING USED FROM ANY LOCATION OTHER THAN THE HOME TO WHICH YOUR SERVICE IS REGISTERED. TVC 911 Service is different from traditional 911 service. TVC will route all 911 calls to those customers who subscribe to Telephone Services the Public Safety Answering Point (PSAP), which serves your location, but the Service is different in a number of important ways from Ziply Fiber.
i) You agree that Ziply Fiber will not be responsible for any losses traditional 911 or damages arising E911 Service as a result of the unavailability of the Telephone Service or the inability to contact your home security system, fire alarm system or remote medical monitoring service provider. You acknowledge that Ziply Fiber does not guarantee that Telephone Service will operate with your home security, fire alarm and/or medical monitoring systems, and that you must contact your service provider in order to test your system’s operation with the Telephone Servicedescribed below. You agree that a service outage due to a suspension inform any household residents, guests and other third persons who may be present at the physical location where you utilize the Service of your account as a result (i) the non-availability of billing traditional 911 or other issues will prevent ALL services from being provided to youE911, including any 911 emergency response services.
and (ii) You acknowledge the important differences in, and limitations of the TVC 911 dialing Service as compared to traditional 911 or E911 dialing. The documentation that accompanies your telephone adapter includes stickers concerning the existing potential non-availability of traditional 911 or E911 dialing (the "911 Sticker"). It is your responsibility, in accordance with the instructions to place the 911 Sticker on each telephone wiring inside your home may not support both Telephone Service and digital subscriber line service (“DSL”) internet servicethat you use with the Service. If you intend to use Telephone Service on all of did not receive a 911 Sticker with your phone jacksdocumentation, or you may be required to maintain separate wiringrequire additional 911 Stickers, not provided by Ziply Fiber, within your home specifically for DSL or to disconnect your DSL prior to receiving Telephone Service over your existing inplease contact our customer care department at 860-home wiring446-4009.
iii) YOU AGREE AND UNDERSTAND THAT ZIPLY FIBER WILL NOT BE LIABLE FOR ANY TELEPHONE SERVICE OUTAGE, INABILITY TO DIAL 911 USING THE TELEPHONE SERVICE, AND/OR INABILITY TO ACCESS EMERGENCY SERVICE PERSONNEL DUE TO THE 911/E911 FEATURE.
