Common use of Temporary Certificate of Occupancy Clause in Contracts

Temporary Certificate of Occupancy. The Agency may, in its reasonable discretion, accept a “Temporary Certificate of Occupancy” for the Improvements from the Department of Building Inspection in lieu of a Certificate of Occupancy under Section 6.5(a); provided, however, that Vertical Developer shall be required to promptly obtain a Certificate of Occupancy and thereafter deliver a copy of the Certificate of Occupancy to the Agency within ten (10) Business Days following receipt thereof.
