Common use of Tenant Representation Clause in Contracts

Tenant Representation. Tenant represents and warrants to Landlord --------------------- that: (i) Tenant does not directly or indirectly control Teachers Insurance and Annuity Association of America ("TIAA") or TIAA Realty, Inc. ("TIAA Realty") and is not directly or indirectly controlled by or under common control with TIAA or TIAA Realty; (ii) neither Tenant nor any principal of Tenant is an officer, director or employee ofTIAA or TIAA Realty, or any subsidiary or affiliate thereof; and (iii) Tenant is not a partnership in which TIAA or TIAA Realty, or any subsidiary or affiliate thereof, is a ten percent (10%) or more (directly or indirectly in capital or profits) partner.
