Tender Preparation. 4.1 Tenderers are advised to read the Tender Documents carefully prior to preparing their submission. Any tender that does not follow the instructions contained in these Terms of Tender may not be considered further. 4.2 Tender shall be completed in English or Chinese, and in ink or typescript and submitted in accordance with the requirements set out in TOT Clause 5. Where a supporting document in its original form is in a language other than English or Chinese, the Tenderer shall provide translation of that supporting document from the language into English or Chinese.
Tender Preparation. 5.1 All Tender Document must be completed and submitted in accordance with the “Lodging of Tender”. 5.2 Tender shall be completed in ink or typescript and in TRIPLICATE (one original and two photocopies) with all necessary information including documentary evidence which are necessary for tender evaluation. 5.3 A tender submitted by a Tenderer shall comprise the Technical Proposal in one envelope and the Price Proposal in another envelope. (i) For the Technical Proposal, it shall comprise the following items in triplicate: (1) Third Schedule Price List of Food and Commodities (2) Appendix II Background of Tenderer (3) Appendix IV Information of Tenderer (4) Others  Copies of other relevant documents required under this tender to prove Tenderer’s background, experience and qualification in the business.  Copies of current Memorandum and Articles of Association, Certificate of Incorporation, and other documents to show nature of business status.  Copies of the current Business Registration Certificate. The certificate should bear a machine printed line to show that full registration fee has been effected. (ii) For the Price Proposal, it shall comprise the following items in triplicate: (1) First Schedule Monthly Fee (2) Part 3 Signed Form of Tender (3) Part 4 Tenancy Agreement 5.4 When completing Part 3 - Form of Tender, Tenderer should ensure that: (i) the name of the Tenderer is the same as the one appearing on : (1) in relation to a Tenderer which is a company incorporated in Hong Kong, the latest of :- (A) the Certificate of Incorporation of the Tenderer; (B) if there has been a change of name, the last Certificate on Change of Name of the Tenderer; or (C) if the Tenderer has a trading name, the last Business Registration Certificate of the Tenderer; or (2) in relation to a Tenderer which is incorporated outside Hong Kong, the latest of a document equivalent to any of (A), (B) and (C) above; and (ii) the form is duly signed by the Tenderer’s authorised person. 5.5 Tenderers should check the numbers of pages of the Tender Document. If they find any missing or indistinct pages, they should inform the Government Representative immediately so that the same can be rectified. Any addition or removal of any page of the Tender Document may render the tender invalid. 5.6 It is the duty of the Tenderer to ensure that it understands all requirements of the Tender Document and to consult its advisors including legal advisor. Tender Preparation. 2.1 In submitting your tender, you do so on the conditions specified or referred to herein, and on the following conditions which shall be paramount, and in the event of breach thereof, University of Winchester shall be entitled to determine any contract made pursuant to such tender and claim damages from you: - 2.1.1 Your tender shall be a “bona fide” tender and shall not be fixed or adjusted by, or under, or in accordance with any agreements or arrangements with any other person. 2.1.2 You shall keep your tender confidential and not divulge to anyone, even approximately, what your tender price is, or will be, or any of its terms or conditions, with the sole exception of information you may have to give, for example, your insurance broker, in order to compile your tender. You must stress to them that such information is given in strictest confidence. 2.1.3 You shall not enter into any agreement or arrangement with any person that such other person shall refrain from tendering, or between them agree as to the amount of any other tender is submitted, or of its terms and conditions. 2.1.4 You must not try to obtain any information about someone else’s tender or proposed tender. You may, however, obtain necessary sub-contract quotations applicable to your tender. 2.1.5 You shall not offer to pay or give, or agree to pay or give, any sum of money or valuable consideration directly to any person for doing, or having done, or causing, or having caused to be done, in relation to the tender any act of a nature described in the preceding conditions. 2.2 This tender does not entitle you to enter University of Winchester premises. Should you require doing so to facilitate preparation of your tender, you must first contact the Procurement Officer who invited you to tender and adhere to the specific instructions provided by that person.
Tender Preparation. 3.1 All information supplied in connection with this invitation shall be regarded as confidential. All material issued in connection with this ITT shall remain the property of the Authority and/or as applicable relevant OCB and shall be used only for the purpose of this procurement exercise (mini-competition). All Due Diligence Information shall be either returned to the Authority or securely destroyed by the Tenderer (at the Authority’s option) at the conclusion of the procurement exercise. 3.2 The Tenderer shall not make contact with any other employee, agent or consultant of the Authority or any relevant OCB who is in any way connected with this procurement exercise during the period of this procurement exercise, unless instructed otherwise by the Authority. 3.3 The Authority shall have no liability for any cost or expense you may incur as a direct or indirect consequence of your tendering for the provision of the services. 3.4 Tenderers should provide all the information requested full and in the format and order specified. Tenderers should confirm how they will meet OGC’s expectations and requirements, complete Pricing Schedule, provide any supporting documentation as applicable and return their proposal/tender to OGC in the manner requested in these instructions.

  • Site Preparation Axon will provide a hardcopy or digital copy of current user documentation for the Axon Devices ("User Documentation"). User Documentation will include all required environmental specifications for the professional services and Axon Devices to operate per the Axon Device User Documentation. Before installation of Axon Devices (whether performed by Customer or Axon), Customer must prepare the location(s) where Axon Devices are to be installed ("Installation Site") per the environmental specifications in the Axon Device User Documentation. Following installation, Customer must maintain the Installation Site per the environmental specifications. If Axon modifies Axon Device User Documentation for any Axon Devices under this Agreement, Axon will provide the update to Customer when Axon generally releases it

  • Proposal Preparation The contractor shall assume all costs associated with preparation of proposals for task order awards under the proposal process as an indirect charge (B&P costs). The Government will not reimburse awardees for proposals as a direct charge.

  • DOCUMENT PREPARATION The Transfer/Deed shall, save for the Land Transfer Tax Affidavit, be prepared in registrable form at the expense of Seller, and any Charge/Mortgage to be given back by the Buyer to Seller at the expense of the Buyer. If requested by Buyer, Seller covenants that the Transfer/Deed to be delivered on completion shall contain the statements contemplated by Section 50(22) of the Planning Act, R.S.O.1990.

  • Joint Preparation The preparation of this Agreement has been a joint effort of the parties and the resulting documents shall not, solely as a matter of judicial construction, be construed more severely against one of the parties than the other.

  • Surface Preparation Clean the surface to be treated of all dust, dirt, clay, grass, sod and any other deleterious matter before application of the asphalt surface treatment.
