Common use of Term and Option to Extend Clause in Contracts

Term and Option to Extend. The Term of this Agreement shall commence April 1, 2023 (Commencement Date) and continue in full force for a period of ten (10) years, through and including April 30, 2033, unless the Agreement is extended in accordance with this Section or terminated pursuant to Section 10.2. At City’s sole discretion, this Agreement may be extended one (1) time without amendment for a period of up to five (5) years. If City desires to extend the Agreement, City shall provide the Contractor with written notice of its decision to extend the Agreement at least one (1) year before the expiration of the initial Term. Such notice by City shall specify the duration of the extension. Between the Effective Date and Commencement Date, Contractor shall perform all activities necessary to prepare itself to start providing services required by this Agreement on the Commencement Date.

Term and Option to Extend. The Term of this Agreement shall commence April July 1, 2023 2022 (Commencement Date) and continue in full force for a period of approximately ten (10) years, through and including April 30June 26, 20332032, unless the Agreement is extended in accordance with this Section or terminated pursuant to Section 10.2. At City’s sole discretion, this Agreement may be extended one (1) time or more times without amendment for a period of up to no more than five (5) yearsadditional years for a total Term that does not extend beyond June 30, 2037. If City desires to extend the Agreement, City shall provide the Contractor with written notice of its decision to extend the Agreement at least one (1) year before the expiration of the initial TermTerm and at least six (6) months before the expiration of any extended term. Such notice by City shall specify the duration of the extension. Between the Effective Date and Commencement Date, Contractor shall perform all activities necessary to prepare itself to start providing services required by this Agreement on the Commencement Date.
