Term of Use. 2.1 User shall be permitted to use the specified area from October 1, 2003 until September 30, 2005. 2.2 Time shall be of the essence for this Agreement, and the period of time granted shall not be extended for occupancy or use of the Center without written permission from the City. No extension of the occupancy or use is presently contemplated and no expectation of such an extension is hereby created. 2.3 This Agreement may be terminated by either party, giving at least 90 days' prior written notice to the other party of its intention to terminate this Agreement; further provided that if the City or User shall fail or refuse to perform or comply with any of the obligations or provisions herein agreed, the affected party shall have the right to notify the other party in writing of such default; and if the party so notified shall remain in default for 30 days thereafter, the affected party may elect to cancel this Agreement immediately thereafter.
