Termination after extended Force Majeure Event. If by reason of a Force Majeure Event a Party (“affected Party”) is rendered unable to perform its obligations under this Agreement for a period of more than three (3) consecutive Months, the Parties must meet in an endeavour to identify any alternative viable means to provide the suspended Access Rights and failing an alternative means being agreed upon within one (1) Month of the end of the three (3) Month period the other Party may terminate this Agreement by thirty
Termination after extended Force Majeure Event. If, by reason of a Force Majeure Event, Aurizon Network is wholly prevented or hindered from carrying out its obligations under this Agreement (other than an obligation to pay money) for a period of more than three consecutive Months, then:
(a) the Parties must meet to endeavour to identify any alternative viable means to perform the suspended obligations; and
(b) failing any alternative means being agreed within one Month after the end of the three Month period, the Access Holder may terminate this Agreement by 20 Business Days’ notice to Aurizon Network and clauses

Aurizon Network must send a written notice of invitation to the End User for, and provide the End User with a reasonable opportunity to participate in, any meeting of the Parties pursuant to this clause 19.6.
Termination after extended Force Majeure Event. Subject to clause 20.6 or the process under clause 20.5 having been finalised (if applicable), if by reason of a Force Majeure Event either Queensland Rail or the Access Holder (relevantly the Afflicted Party) is rendered unable to perform its obligations under this agreement for a period of more than 6 consecutive months, the Access Holder and Queensland Rail must meet in an endeavour to identify any alternative viable means to provide the suspended Access Rights and failing an alternative means being agreed upon within one month of the end of the six month period the other Party may terminate this agreement by 30 days’ written notice to the Afflicted Party and the provisions of this agreement relating to termination set out in clauses 15.9 and 15.10 apply without prejudice to any of the rights of the Parties accrued prior to the date of such termination.

If, by reason of a Force Majeure Event affecting a Party, that Party (affected Party) is wholly prevented or hindered from carrying out its obligations under this Agreement (other than an obligation to pay money) for a period of more than three consecutive Months, then:
(a) the Parties must meet to endeavour to identify any alternative viable means to perform the suspended obligations; and
(b) failing any alternative means being agreed within one Month after the end of the three Month period, the other Party may terminate this Agreement by 20 Business Days written notice to the affected Party and clauses 24.4 and 24.5 apply without prejudice to any of the rights of the Parties which accrued before the date of such termination.
