Common use of Termination by the Board Clause in Contracts

Termination by the Board. The Board unilaterally and without cause may terminate this Agreement and employment of the Assistant Superintendent. In consideration of the Board's right to terminate this Agreement without cause, the Board shall pay the current salary of the Assistant Superintendent, as provided for in Section 6, Salary, of this Agreement, or any amendment thereto, for the remainder of the Agreement, but not to exceed twelve (12) months consistent with Government Code Sections 53260 and 53261. Upon termination of this Agreement pursuant to this section, the Assistant Superintendent shall continue to receive the fringe benefits to which he or she was previously entitled for the remainder of this Agreement, but not to exceed twelve (12) months, or until the Assistant Superintendent finds other employment, whichever occurs first, in accordance with Government Code Section 53261.

In consideration of the Board's right to terminate this Agreement without cause, the Board shall pay the current salary of the Assistant Deputy Superintendent, as provided for in Section 6, Salary, of this Agreement, or any amendment thereto, for the remainder of the Agreement, but not to exceed twelve (12) months consistent with Government Code Sections 53260 and 53261. Upon termination of this Agreement pursuant to this section, the Assistant Deputy Superintendent shall continue to receive the fringe benefits to which he or she was previously entitled for the remainder of this Agreement, but not to exceed twelve (12) months, or until the Assistant Deputy Superintendent finds other employment, whichever occurs first, in accordance with Government Code Section 53261.

In consideration of the Board's ’s right to terminate this Agreement without cause, the Board shall pay to the current salary of Assistant Superintendent an amount equal to the Assistant Superintendent’s then current salary, as provided for in Section 6, Salary, paragraph 4 of this Agreement, or any amendment theretohereof, for the remainder of the Agreement, but not to exceed twelve eighteen (1218) months consistent with Government Code Sections 53260 and 53261Section 53260. Upon termination of this Agreement pursuant to this section, the Assistant Superintendent shall continue to receive the fringe benefits to which he or she was previously entitled for the remainder of this Agreement, but not to exceed twelve eighteen (1218) months, or until the Assistant Superintendent finds other employment, whichever occurs first, first in accordance with Government Code Section 53261.
