Common use of Termination by the Parents Clause in Contracts

Termination by the Parents. Except when the Pupil is to leave at the end of the Upper Sixth (Year 13) or clause 9.10 below applies, if the Parents wish to Withdraw the Pupil or Cancel and terminate this contract at any time after the expiry of the 14 day cancellation period described in clause 9.6 above, if applicable, they shall do so either by: 9.8.1 providing at least one ▇▇▇▇'s Written Notice; or 9.8.2 paying one Term's Fees in lieu of Notice. In circumstances where the Parents Cancel by providing at least one Term's Written Notice, the Foundation shall retain the Acceptance Deposit. In all other circumstances where the Parents Cancel or Withdraw the Pupil, the Acceptance Deposit will be repaid in accordance with clause 3.3. The Foundation reserves the right to offset the Additional Deposit, if paid, against the Term's Fees in lieu of Notice.
