Termination Due to Lack of Funds or Change in Law. The State shall have the right to terminate its Contract without penalty by giving 30 days’ written notice to the Contractor as a result of any of the following: 1.6.5.1 Adequate funds are not appropriated or granted to allow the State to operate as required and to fulfill its obligations under the Contract; 1.6.5.2 Funds are de-appropriated or not allocated or if funds needed by the State, at the State’s sole discretion, are insufficient for any reason; 1.6.5.3 The State’s authorization to operate is withdrawn or there is a material alteration in the programs administered by the State; 1.6.5.4 The State’s duties are substantially modified.
