Common use of Termination of Right to Pay in Common Stock Clause in Contracts

Termination of Right to Pay in Common Stock. Notwithstanding anything to the contrary in the Securities or the Indenture or otherwise, the Company in its sole discretion may elect to terminate its right to pay in Common Stock, in whole or in part, with respect to any purchase, repurchase or redemption of any Security (or portion thereof) by providing a notice to the Trustee of such election.
