Common use of Termination of Route Segment Clause in Contracts

Termination of Route Segment. Any Route Segment may be terminated: (i) by NU upon reasonable notice for the purposes of providing safe and economical electrical service; or (ii) by NECOM upon five days prior written notice if two Cable failures per month for three consecutive months occur on a Route Segment as a result of NU's electric operations and NU fails to take steps to cure such failure with due diligence, unless NU shall have cured such failure prior to the expiration of said five day period, or where cure is not possible within said five day period, NU is proceeding to cure with due diligence. (iii) by NU at any time after consultation with NECOM if it cannot obtain the regulatory approvals needed by it to perform its obligations under this Agreement with respect to such Route Segment or can obtain them but on terms that are unduly burdensome on NU.
