Common use of Terms of Use Clause in Contracts

Terms of Use. You must comply with all terms of this Agreement. You must comply with: a. Football Australia’s applicable rules and regulations (including National Code of Conduct and Ethics and Spectator Code of Behaviour, available at ▇▇▇▇▇://▇▇▇.▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇.▇▇/governance/statutes-and-regulations or on request), to the extent that such do not directly conflict with the rights granted in your Accreditation; and b. the Venue operator’s rules and regulations (including the Terms of Admission and where applicable, COVID-19 General Access Rules as prescribed by Football Australia and/or the Venue operator from time to time), which may include: i. pre-entry screening requirements such as temperature checks, evidence of COVID-19 vaccination and QR code check-in; ii. face masks and physical distancing requirements; iii. other health checks and requirements as determined by local Health Orders; and iv. general inspections, bag checks, and the removal of any prohibited and restricted items. You acknowledge that the Accreditation: a. is issued to you personally and cannot be loaned, transferred, assigned or licensed to any other person; and b. must be worn and prominently displayed at all times while in the Venue, other than when your role at the Subway Socceroos vs New Zealand All Whites match at Gtech Community Stadium, Brentford, London UK on Tuesday, 17 October 2023 (Match) prevents you from doing so (such as television presenters on camera). c. Depending on your role, a further condition (such as wearing a designated bib) may be imposed on access to certain zones within the Venue. d. Where in the event you’re provided with a match day ticket in addition to media accreditation, it is an essential condition of this Agreement and of the right of admission to the Match conferred on the holder of a ticket that you agree with Football Australia: i. not to resell or transfer, or attempt to resell or transfer, the ticket at a premium; ii. not to use it for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services; and iii. not to bundle it with other goods or services, without Football Australia’s prior consent. If this condition is breached, Football Australia may, in addition to any other remedy and even if the holder of the ticket did not have notice of the condition or the breach, deny the holder admission to the Match and retain the price of the ticket. iv. You will gain entry to the Venue (and a zone within the Venue) on presentation of valid Accreditation and where applicable, the provided match day ticket, plus if requested, proof of identity. You must not: • carry or wear any political, promotional, advertising, or other commercial material of whatever nature (save for material provided by Football Australia), which is visible at the Match; or • do anything which brings Football Australia, the Match or football into disrepute. • You must comply with the directions of Football Australia staff or those appointed by Football Australia into Event or Media Management roles whilst in and around the Venue on Match Day. • You must not use any information obtained as a result of your Accreditation for the purpose of anyone betting on, or in relation to, the Match or in any other way which may amount to a breach of Football Australia’s National Code of Conduct and Ethics. • The Competition Administrator may at any time issue further directions, conditions and policies relating to Accreditation and access to the Venue, which you must comply with. 1. You agree that an inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. You assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting COVID-19 or any other communicable disease or illness, or a bacteria, virus or other pathogen capable of causing a communicable disease or illness, whether occurring before, during, or after the event, however caused or contracted, and voluntarily waive all claims and potential claims against Football Australia and the Venue operator relating to such risks. 2. You should source your own Personal Protection Equipment. 3. You must comply with all with all applicable government restrictions, directives of health authorities and directions, conditions and policies of Football Australia and the Venue relating to health and safety.

You must not: • carry or wear any political, promotional, advertising, or other commercial material of whatever nature (save for material provided by Football Australia), which is visible at the Match; or • do anything which brings Football Australia, the Match or football into disrepute. • You must comply with the directions of Football Australia staff or those appointed by Football Australia into Event or Media Management roles whilst in and around the Venue on Match Day. • You must not use any information obtained as a result of your Accreditation for the purpose of anyone betting on, or in relation to, the any Match or in any other way which may amount to a breach of Football Australia’s National Code of Conduct and Ethics. • The Competition Administrator may at any time issue further directions, conditions and policies relating to Accreditation and access to the Venue, which you must comply with. 1. You agree that an inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. You assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting COVID-19 or any other communicable disease or illness, or a bacteria, virus or other pathogen capable of causing a communicable disease or illness, whether occurring before, during, or after the event, however caused or contracted, and voluntarily waive all claims and potential claims against Football Australia and the Venue operator relating to such risks. 2. You should source your own Personal Protection Equipment. 3. You must comply with all with all applicable government restrictions, directives of health authorities and directions, conditions and policies of Football Australia and the Venue relating to health and safety.
