Common use of The Allegation Clause in Contracts

The Allegation. a) Any allegation for breach of this clause shall be directed to the Employer and shall be in writing stating: i) the nature of the allegation; ii) the proof supporting the allegation: and iii) the source of the allegation. b) The person/s making the allegation must have direct knowledge of the alleged breach and shall be required to support the allegation in conformity with the provisions as outlined in paragraph (a) of this subclause. c) The Employer and/or the person/s making the allegation should observe confidentiality at all times and the Employer shall advise such person/s of the seriousness of their allegation and counsel such person/s of the consequences of malicious, false or exaggerated allegations. d) The Employer shall record the details of the allegation and where necessary clarify any matter pertaining to the allegation.
