Common use of The Card Clause in Contracts

The Card. 4.1. The Cardholder will be given an ATM card that is linked to the Account. The Cardholder shall be responsible for the physical security of the Card. The Bank and any of its authorized officer, employee, associate or agent may retain the Card, require the Cardholder to return the Card or suspend the use of the Card at any time in its absolute discretion. The Bank shall not be liable for any losses or damages suffered by the Cardholder as a result thereof. 4.2. The Card will not become valid or operational until the Cardholder acknowledges receipt of the Card by signing on the appropriate Bank documents. The Card is only valid for the period shown on it unless sooner revoked by the Bank upon prior notice via SMS and/or email to the Cardholder. Upon the expiration of the Card, the Cardholder must immediately destroy the Card by cutting it in half through the magnetic strip. Any unauthorized use of the Card after its expiration or revocation shall be exclusively borne by the Cardholder. 4.3. If the Card is lost or stolen, the Cardholder or any other person acting on behalf of the Cardholder shall immediately notify the Bank by calling the Bank’s Customer Service at (▇▇) ▇▇▇▇-▇▇▇▇ and request for card blocking. The Cardholder understands that the request for card blocking shall be subject to the Bank’s KYC procedure, in which case, the Cardholder shall be required to provide his/her card number(s) and other pertinent information to establish his/her proper identity. In addition, the Cardholder must immediately notify the concerned institutions and relevant law enforcement agencies pertaining to the lost or stolen Card. All usage made prior to the reporting of the lost/stolen Card shall be conclusively binding to the Cardholder. As such, the Bank shall not be liable for any loss or damage incurred by the Cardholder prior to his/her proper notice to the Bank of the loss or stolen card and the corresponding request for card blocking. 4.4. In cases where the card is lost or stolen, the Cardholder hereby agrees to cooperate with any officers, service providers, employees, associates or agents of the Bank and/or law enforcement agencies in the effort to recover the Card. The Cardholder understands and agrees that the Bank may disclose information about the Cardholder and the Account should the Bank, at its own discretion, deem it necessary to help avoid or recover any loss to the Cardholder or the Bank resulting from the loss, theft, misuse or unauthorized use of the Card. 4.5. The Card is issued for the exclusive use of the Cardholder and is non-transferable and cannot be lent for the temporary use of any other person, nor can the same be pledged or charged as security for any reason and in any manner whatsoever. 4.6. All transactions done through the Card is assumed to have been made by or authorized by the Cardholder.

The Card. 4.12.1 You shall be deemed to have unconditionally agreed to be bound by this Cardholder Agreement by acknowledging receipt of the Card in writing or by signing on the reverse of the Card or by incurring a Charge on the Card. If you do not wish to be bound by this Agreement then you must cut the Card in half and return it to SBICPSL promptly. 2.2 The Card is the property of SBICPSL and must be surrendered to SBICPSL on request. The Cardholder must not permit any other person to use the Card and should safeguard it from misuse by retaining it under his/her personal control at all times. 2.3 Each Cardholder may be issued a personal identification number or a password (PIN) to enable use of the Card for accessing his/her Card Account on the ATM and Internet and also for availing any privilege, benefit or service that may be offered by SBICPSL on the Card. The PIN will be given an ATM card that is linked communicated to the AccountCardholder entirely at his/her risk, who shall not disclose the PIN to any person and shall take all possible care to avoid its discovery by any person. The Cardholder shall be responsible liable for the physical security of the Card. The Bank and any of its authorized officer, employee, associate or agent may retain the Card, require the Cardholder to return the Card or suspend all transactions made with the use of the Card at PIN, whether with or without the knowledge of the Cardholder. SBICPSL reserves the right to refuse any time in its absolute discretion. The Bank shall not be liable for any losses transactions if it believes that the PIN is being misused or damages suffered by the Cardholder as a result thereofbeing used without appropriate authorisation. 4.2. 2.4 The Card will not become is valid or operational until up to the Cardholder acknowledges receipt last day of the month of the year indicated on the face of the Card by signing on the appropriate Bank documents. The Card is only valid for the period shown on it unless sooner revoked by the Bank upon prior notice via SMS and/or email to the Cardholdercancelled earlier. The Joining and Annual fee(s) are subject to change at the discretion of SBICPSL and are not refundable. 2.6 SBICPSL may, based on the Primary Cardholder's written request, issue Additional Cards to individuals nominated by the Primary Cardholder who shall be exclusively borne unconditionally bound by the Cardholderthis Agreement. 4.3. If the Card is lost or stolen, the Cardholder or any other person acting on behalf of the Cardholder shall immediately notify the Bank by calling the Bank’s Customer Service at (▇▇) ▇▇▇▇-▇▇▇▇ and request for card blocking. 2.7 The Cardholder understands that the request for card blocking shall be subject to the Bank’s KYC procedure, in which case, the Primary Cardholder shall be required fully liable to provide SBICPSL for all the Charges on his/her card number(s) Card and other pertinent information also for those incurred by the Additional Cardholders. The Additional Cardholders shall be jointly and severally liable to establish his/her proper identity. In addition, SBICPSL for all the Cardholder must immediately notify Charges even though the concerned institutions and relevant law enforcement agencies pertaining monthly statement of account may be sent only to the lost or stolen Card. All usage made prior to the reporting of the lost/stolen Card shall be conclusively binding to the Primary Cardholder. The Cardholder and the Company undertake to promptly inform the Bank if the renewal card is not received by the Card is issued for expiry date. In cases where the card is lost or stolen, the Cardholder hereby agrees to cooperate with any officers, service providers, employees, associates or agents of the Bank Bank, notified to the Cardholder as having been authorized by the Bank, and/or the concerned institutions and/or law enforcement agencies mentioned in Section 4.3 above in the effort to recover the Card.
