The Contracts (Rights of Third Parties. ACT 1999 40.1 Subject to the provisions of clause 21.10 above, a person who is not a Party to the Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its provisions which, expressly or by implication, confer a benefit on him, without the prior written agreement of the Parties, but this does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act and does not apply to the Crown. 40.2 No consent of the Replacement Supplier is necessary for any variation (including any release or compromise in whole or in part of any liability) or termination of this Contract or any one or more clauses of it.
