The SCCs Clause Samples

The SCCs, or Standard Contractual Clauses, are standardized legal provisions designed to ensure that personal data transferred from the European Economic Area to countries outside the EEA is adequately protected in compliance with EU data protection laws. These clauses are typically incorporated into contracts between data exporters and data importers, outlining specific obligations regarding data security, rights of data subjects, and mechanisms for addressing breaches. By providing a legally recognized framework for international data transfers, the SCCs help organizations comply with regulatory requirements and mitigate the risks associated with cross-border data movement.
The SCCs. The standard contract clauses are the clauses set out in the European Commission’s Decision of 5 February 2010 on standard contractual clauses for the transfer of personal data to data-processors established in third countries, under the Directive 95/46/EC on the protection of individuals with regard to the processing of personal data and on the free movement of such data (as the European Commission may amend or replace from time to time). They are incorporated into this agreement by this reference and attached in their current form as Annexure 5.
