Common use of The Settling Parties represent Clause in Contracts

The Settling Parties represent. 9.1.1 That they are voluntarily entering into this Settlement Agreement as a result of arm’s length negotiations among their counsel, and that in 9.1.2 That they assume the risk of mistake as to facts or law; 9.1.3 That they recognize that additional evidence may have come to light, but that they nevertheless desire to avoid the expense and uncertainty of litigation by entering into the Settlement; 9.1.4 That they have read carefully the contents of this Settlement Agreement, and this Settlement Agreement is signed freely by each individual executing this Settlement Agreement on behalf of each of the Settling Parties; and 9.1.5 That they have made such investigation of the facts pertaining to the Settlement and all matters pertaining thereto, as they deem necessary.
