Common use of Third Party Service Provider Clause in Contracts

Third Party Service Provider. You acknowledge and agree that we may engage third party service providers, including (but not limited to) brokers, custodians, and settlement and clearing agents (“Third Party Service Providers”) in connection with trading conducted on local or foreign markets. You acknowledge and agree that we shall be under no obligation to take any action whatsoever against any Third Party Service Provider in respect of any loss or damage suffered by you arising out of any act or omission on the part of such Third Party Service Provider, and covenant not to hold us responsible or liable in any manner for any such loss or damage unless we are guilty of fraud or wilful default which also contributes to the Third Party Service Provider’s act or omission.
