Third Party Services or Software. We may make services provided by third parties available to you. The third-party services are optional and offered for your convenience. Any third-party service is provided by the third party, and not by us. You assume all risks associated with using any third-party service, and we have no liability to you in respect of any third-party service. Any dispute you may have relating to a third party service must be resolved between you and the third party, without our involvement. If a third-party deals with us in its provision of services to you, the third party is acting as your agent and not ours. Where there are links from our website or within Digital Banking Services to any third party’s website, we do not make any representations about, do not endorse, and are not responsible for any losses relating to, the third party or the third party’s website, products, services or privacy policies. If we use third-party service providers to assist us in providing software, you accept that the software comes “as is” and you assume the entire risk for the performance of the software. Third party service providers will not be liable to you for any damages resulting from your use of the software, under this Agreement or otherwise.

  • Third Party Software The Software may contain third party software which requires notices and/or additional terms and conditions. Such required Third Party Software notices and/or additional terms and conditions are located at ▇▇▇▇▇://▇▇▇.▇▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇/▇▇▇▇-third-party/ (or a successor website thereto) and are made a part of and incorporated by reference into this Agreement.

  • Licensed Software Computer program(s) provided by Contractor in connection with the Deliverables, subject to Section 14 of this Contract.

  • Third Party Products and Services Any third-party hardware, software and/or services that is delivered by ResMed for use either standalone or in conjunction with ResMed products and/or services, shall be subject to the third-party terms and conditions and/or license agreements between Customer and the third party. Such third-party hardware, software and/or services is provided by ResMed "AS IS," without any warranty of any kind. Any representations or warranties as to such hardware, software and/or services shall only be as granted by the applicable third parties, if any, that accompany such products and/or software and/or services. Any representations, warranties, or other similar obligations with respect to such third-party hardware, software and/or services flow directly from the third party to Customer and ResMed shall have no responsibility at all for any such representations, warranties, obligations or lack thereof.

  • Third Party Services Any services required for or contemplated by the performance of the above-referenced services by the Administrator to be provided by unaffiliated third parties (including independent auditors’ fees and counsel fees) may, if provided for or otherwise contemplated by the Financing Order and if the Issuer deems it necessary or desirable, be arranged by the Issuer or by the Administrator at the direction (which may be general or specific) of the Issuer. Costs and expenses associated with the contracting for such third-party professional services may be paid directly by the Issuer or paid by the Administrator and reimbursed by the Issuer in accordance with Section 2, or otherwise as the Administrator and the Issuer may mutually arrange.
