Through Warranty. If applicable, Contractor shall pass through to GCHP any product and third party warranties and indemnities associated with the Services. If Contractor is not permitted to pass-through such warranties, Contractor shall assert and enforce such warranties and indemnities on behalf of GCHP.
Through Warranty. To the extent assignable by CyncHealth Iowa to Participant, CyncHealth Iowa assigns and passes through to Participant, and Participant shall have the benefit of, any and all third-party warranties and indemnities pertaining to the System. If such warranties and indemnities made to CyncHealth Iowa are not assignable to Participant, and if the vendor provides no applicable warranties or indemnities directly to Participant, then during the term of this Agreement, CyncHealth Iowa shall use reasonable efforts to enforce for the benefit of Participant such applicable warranties and indemnities as are made by the vendor to CyncHealth Iowa. Participant understands and agrees that its sole remedy for the breach of any such warranty or indemnity shall be against the third-party vendor and not against CyncHealth Iowa, nor shall any such breach have any effect whatsoever on the rights and obligations of either Party with respect to this Agreement.

  • Virus Warranty The Contractor represents and warrants that Licensed Software contains no known viruses. Contractor is not responsible for viruses introduced at Licensee’s site.

  • Price Warranty The Contractor warrants that the prices for the items sold to the City hereunder are not less favorable than those currently extended to any other customer for the same or similar items in similar quantities. The Contractor warrants that prices shown on this Purchase Order/Vendor Contract are complete, and that no additional charge of any type shall be added without the City’s express written consent.

  • Service Warranty Provider has carefully examined and analyzed the provisions of this Agreement, including but not limited to all exhibits attached and incorporated into it, and can and will perform, or cause, the Services to be performed in strict accordance with the provisions and requirements of the Agreement. Services will be performed in a timely, professional and workmanlike manner in accordance with all applicable industry and professional standards.

  • Workmanship Warranty Contract warrants that all components or deliverables specified and furnished by or through Contractor under the Project Definition/Work Order meet the completion criteria set forth in the Project Definition/Work Order and any subsequent statement(s) of work, and that services will be provided in a workmanlike manner in accordance with industry standards.
