Time Limit for Filing. No grievance shall be entertained or processed unless it is filed within the time limits set forth in Section 4.2. If a grievance is not presented by the employee within the time limits set forth above, it shall be considered "waived" and may not be pursued further. If a grievance is not appealed within the time limits for appeal set forth above, it shall be deemed settled on the basis of the last answer of the City and shall not be subject to further appeal. If the City fails to provide an answer within the time limits so provided, the Union may elect to treat the grievance as denied at that step and immediately appeal to the next step. The parties may by mutual agreement in writing extend any of the time limits set forth in this Article.
