Time Limitation on Claims. 16.1 The Supplier’s liability is limited to defects which appear within a peri- od of three (3) years from the date of delivery. As to substitute Compo- nents, the same time limitations shall apply from the date of delivery of the substitute Components. 16.2 The Supplier’s limitation of liability described above shall however not apply (i) if the Supplier has acted with gross negligence or in bad faith; or (ii) in relation to Epidemic Failures irrespective of whether the Supplier has acted with gross negligence or in bad faith.
