Common use of Time Progress Schedule Clause in Contracts

Time Progress Schedule. (1) To show compliance with the requirements of Section 3.01 of the Agreement, provide and maintain a Time Progress Schedule in accordance with the General Requirements, Special Conditions, Section paragraph titled “Project Schedule”. Unless otherwise accepted by the Fund, the Time Progress Schedule shall be strictly adhered to by the Contractor. Unless otherwise approved by the Fund, the date for final completion in the Time Progress Schedule shall be on or before the time specified on page A-1 of the Agreement. (2) If through the fault of the Contractor or any subcontractor the Contractor shall fail to adhere to the time progress schedule, it must promptly adopt such other and additional means and methods of construction as will make up for the time lost and will assure completion in accordance with such schedule. (3) The failure of the Contractor to submit a Time Progress Schedule, the Fund's or the Consultant's acceptance of the Contractor's time progress schedule or lack of such acceptance, the means and/or methods of construction employed by the Contractor, including any revisions thereof, and/or its failure to revise the same shall not relieve the Contractor of its obligation to accomplish the result required by the Contract in the time specified on page A-1 of the Agreement, nor shall the exercise of the Consultant’s right to reject any portion of the work, create or give rise to any claim, action or cause of action, legal, equitable or otherwise, against the Consultant or the Fund.
