Timeframes and Communications. 1. All time designations shall be in calendar days unless otherwise stipulated. If any Signatory does not object to FEMA’s determination related to an Undertaking within an agreed upon timeframe, FEMA may proceed to the next step in the consultation process as described in Stipulation II, Project Review. Due to the varied nature of Undertakings, the individual response times to FEMA’s requests for comment/concurrence may vary. The consulting parties may send and accept official notices, comments, requests for further information and documentation, and other communications required by this Agreement by e-mail. 2. For Emergency Undertakings as outlined in Stipulation II.B.2(c)(i), Expedited Review of Emergency Undertakings, the SHPO and participating Tribe(s) shall respond to any FEMA request for comments within three (3) days after receipt, unless FEMA determines the nature of the emergency action warrants a shorter time period. 3. For all other Undertakings associated with the Individual Assistance (IA) and Public Assistance (PA) programs, the review time shall be a maximum of fifteen (15) days. 4. For the Hazard Mitigation Grant Program (HMGP) and all non-disaster programs, the response time for each request for concurrence shall be a maximum of thirty (30) days. PROJECT REVIEW Programmatic Allowances If FEMA determines an Undertaking conforms to one or more allowances in Appendix B of this Agreement, FEMA shall complete the Section 106 review process by documenting this determination in the project file, without SHPO and participating Tribe(s) review or notification.

2. a. For Emergency Undertakings as outlined in Stipulation II.B.2(c)(i)II.B, Expedited Review of Emergency Undertakings, the SHPO and participating Tribe(s) shall respond to any FEMA request for comments within three (3) days after receipt, unless FEMA determines the nature of the emergency action warrants a shorter time period. In all cases, FEMA will be clear that an “expedited project review” is requested.
3. b. For all other Undertakings associated with the Individual Assistance (IA) and Public Assistance (PA) programs, while the review Joint Field Office (JFO) is open, the response time for each request for concurrence shall be a maximum of fifteen ten (1510) days, or in accordance with temporary timelines established by FEMA on a Declaration by Declaration basis.
4. c. For the Hazard Mitigation Grant Program (HMGP) and ), all non-disaster programs, and PA projects submitted for review after the JFO has closed, the response time for each request for concurrence shall be a maximum of thirty (30) days.
