Common use of Title Commitment and Title Documents Clause in Contracts

Title Commitment and Title Documents. Before the Effective Date, the EDC and CDC at their sole cost and expense shall cause to be ordered from the Title Company (a) a Commitment for Owner’s Policy of Title Insurance (the “Title Commitment”) prepared and issued by the Title Company describing and covering the EDC Tract and the CDC Tract, and (b) true, correct and legible copies of all recorded documents relating to easements, rights-of-way, and any instruments referred to in the Title Commitment as constituting exceptions or restrictions upon the title of Exide (the “Title Documents”).
