TITLE SEARCH Clause Samples

The TITLE SEARCH clause establishes the requirement for a thorough examination of public records to verify the legal ownership and status of a property’s title before a transaction is completed. Typically, this process involves reviewing deeds, mortgages, liens, and other encumbrances to ensure there are no unresolved claims or defects that could affect the buyer’s rights. By mandating a title search, the clause helps prevent future disputes over ownership and protects parties from unforeseen legal or financial liabilities related to the property.
