Title to Properties; Priority of Liens Sample Clauses
The "Title to Properties; Priority of Liens" clause establishes the rules regarding ownership of property and the order in which claims or liens against that property are recognized. Typically, this clause clarifies that the borrower must have clear and marketable title to the property, and that the lender’s lien (such as a mortgage or security interest) will have priority over other claims, except for certain permitted encumbrances like taxes or pre-existing liens. By defining these priorities, the clause protects the lender’s interest in the collateral and ensures that, in the event of default, the lender’s claim will be satisfied before others, thereby reducing the lender’s risk and providing certainty regarding the enforceability of their security interest.
