To Each Participating Class Member. An Individual Class Payment calculated by (a) dividing the Net Settlement Amount by the total number of Workweeks worked by all Participating Class Members during the Class Period and (b) multiplying the result by each Participating Class Member’s Workweeks.

The 80% of each Participating Class Member’s Individual Class Payment will be allocated to settlement of claims for [e.g., interest and penalties] (the “Non-Wage Portion”).vi The Non-Wage Portions are not subject to wage withholdings and will be reported on IRS 1099 Forms. Participating Class Members assume full responsibility and liability for any employee taxes owed on their Individual Class Payment.
3.2.4.2. Effect of Non-Participating Class Members on Calculation of Individual Class Payments. Non-Participating Class Members will not receive any Individual Class Payments. The Administrator will retain amounts equal to their Individual Class Payments in the Net Settlement Amount for distribution to Participating Class Members on a pro rata basis.
To Each Participating Class Member. The Settlement Administrator will compute the settlement payment attributable to each Class Member by: (1) summing the total amount of rent paid by a Participating Class Member; (2) dividing that number by the total amount of rent paid by all Class Members; and (3) multiplying the resultant number by the Net Settlement Amount. In other words, the mathematical formula is: Individual Class Payment = [total rent paid by Participating Class Member / total rent paid by all Class Members] x the Net Settlement Amount. The average (mean) payout to each Participating Class Member is estimated to be approximately One-Thousand Dollars ($1,000).

To Each Participating Class Member. An Individual Class Payment shall be paid to each Participating Class Member based on a pro rata share of the Net Settlement Amount calculated based on the number of Workweeks during the Class Period. To calculate the amount each Class Member will receive, the Net Settlement Amount will be divided by the total number of Workweeks during the Class Period to determine the base dollar amount per Workweek. The result will be multiplied by each Participating Class Member’s Workweeks to yield their Individual Class Payment.
