Common use of To the Fees Clause in Contracts

To the Fees. For Services that are billed on a usage only or month-to-month basis, we may increase fees at any time on thirty (30) days advance notice. For Services that are billed under a term commitment longer than one month, we may increase your fees effective as of the first day of the renewal term following our notice to you of the fee increase. Notwithstanding anything else in the Agreement to the contrary, no more than once per calendar year, Savvis may increase the fees for Services with a term commitment longer than one month in an amount not to exceed the latest annual increase in the Consumer Price Index, specifically, the U.S. Department of Labor, Bureau of Labor Statistics "All Items Consumer Price Index for All Urban Consumers (CPI-U) for the U.S. City Average". Such increase shall be effective upon the date set forth in our notice of the increase to you.
