Tracking Devices. 19.1. Tracking Device is equipment that records the location of Employees, by the use of equipment that uses Global Positioning System (GPS) or by another similar system e.g. In Vehicle management systems, mobile device applications etc. 19.2. This clause shall apply where the Company does not have a specific clause that has been previously negotiated and agreed by the parties. Should there be policy agreed prior to this agreement it will be attached with the Appendix G 19.3. The Company shall not use or implement a tracking device following clause 12 19.4. Before implementation the Company shall inform the hold discussion with All Parties. 19.5. In the event of such an agreement being made and a tracking device being introduced, the following will apply as a minimum in respect of the information derived from tracking devices: i) The information cannot and will not be used for intrusive monitoring of Employees. ii) Employees will be provided, in written request, with access to all available information relevant to them. iii) An Employee can authorise their AWU Delegate in writing to access this information on their behalf. iv) The Company must not, and cannot use, the information as, indirectly or directly, and/or in connection with; a. performance monitoring; b. to set or assess individual performance benchmarks, or the like, for an Employee; c. disciplinary action; and/or d. Evidence against an Employee in applying disciplinary action to that Employee or in any legal action for unfair dismissal or the like. e. Any disputes regarding this clause or any matter relating to the use of a tracking device shall be dealt with via the disputes procedure in this Agreement. f. If the Company see an unsafe pattern of behaviour the Company may toolbox the Employees about the pattern of behaviour as a form of safety education.
