Common use of Trade Fixtures, Personal Property and Improvements Clause in Contracts

Trade Fixtures, Personal Property and Improvements. After the expiration or other termination of the Term, all of Tenant’s trade fixtures, personal property and improvements remaining in the Premises shall be deemed conclusively to have been abandoned by Tenant and may be appropriated, sold, destroyed or otherwise disposed of by Landlord without notice or obligation to compensate Tenant or to account therefore, and Tenant shall pay to Landlord on written demand all reasonable, out-of-pocket costs incurred by Landlord in connection therewith.

Trade Fixtures, Personal Property and Improvements. After the termination or expiration or other termination of the Term, all of Tenant’s trade fixtures, personal property and improvements remaining in the Premises shall be deemed conclusively to have been abandoned by Tenant and may be appropriated, sold, destroyed or otherwise disposed of by Landlord with reasonable notice, but without notice or obligation to compensate Tenant or to account thereforetherefor, and Tenant shall pay to Landlord on written demand all reasonable, out-of-pocket net costs incurred by Landlord in connection therewithwith appropriation, sale, destruction or other disposition of such abandoned trade fixtures and personal property.
