Trail Connections. Subject to standard and typical review of the development plans for the Project, Owner agrees to make reasonable efforts to provide on the Property, in accordance with standard City detail at the time of construction, a path and typical accoutrements and connect this path; A. to the west of the future Frederick County H&F Trolley Trail at Yellow Springs Elementary School along the east side of Yellow Springs Road (connecting via Winpenny Drive and Yellow Springs Road); and B. to the east of the Tuscarora Creek Trail segment within the ▇▇▇▇▇▇ Bluff subdivision (currently terminating at Infantry Drive), along an alignment to be determined by the Planning Commission at the time of preliminary plat approval. C. The parties agree that the connections contemplated above shall be consistent with the City Trails Plan and the Frederick County Bikeway and Trails Plan effective at the time of Final Annexation. D. The parties further agree that if acquisition of public right-of-way from third parties (including, but not limited to Frederick County, Maryland) is required to construct the shared use path and to make the contemplated connections, then the City shall make reasonable efforts to acquire such right-of- way. If the City has not acquired the required right-of-way within one (1) year of the applicable Preliminary Plan approval, then the Owner may proceed with the Project with the shared use path shown on the Property under its ownership/control, with only Staff level amendments required to conform the applicable Preliminary Plan, notwithstanding anything to the contrary in the LMC.
Trail Connections. Developer shall construct and install the trail improvements for the Subdivision as shown on the Plans. Developer shall construct trail segments for the Subdivision in connection with each phase of the Subdivision in the same year as each phase as indicated on the Subdivision Phasing Plan. Unless otherwise approved by the City at any time from and after the Effective Date, the trail connections along Aberdeen Avenue and County Road 66 shall be constructed in accordance with the following respective phases of Subdivision as shown on the Subdivision Phasing Plan: A. Phase 1: Trail segment along Aberdeen Avenue extending from the existing trail at PID 220870010 (Oak Terrace Senior Housing Property) to Park Street B. Phase 3: Trail segments along the west side of Aberdeen Avenue extending from Park Street to County Road 66, and along County Road 66 from Aberdeen Avenue to Prospect Point Road as shown on the Plans and the trail segments along the south and east sides of the parcel located southeast of the Property with PID 109250060 owned by ▇▇▇▇▇▇ and ▇▇▇▇ ▇▇▇▇▇▇▇▇▇ (collectively the “Phase 3 Trail Segments”). Prior to Developer commencing any work on the Phase 3 Trail Segments, the City shall acquire, at Developer’s sole cost which cost shall not exceed $15,000.00, for any and all easements and/or right-of-way rights and interests as needed to construct the Phase 3 Trail Segments over, on and across the real property with PID 109250060 owned by ▇▇▇▇▇▇ and ▇▇▇▇ ▇▇▇▇▇▇▇▇▇ (the “▇▇▇▇▇▇▇▇▇ Property”). To the extent that the acquisition of the Phase 3 Trail Segments cost more than $15,000.00, the City shall pay any additional or excess costs above $15,000.00 except that Developer shall also pay all costs for necessary screening and fence relocation and incidentals.. On or before December 31, 2024 (the “Phase 3 Trail Design Deadline”), Developer shall design to City and County satisfaction the Phase 3 Trail Segments. The City shall obtain any and all easements and/or right-of-way rights and interests as needed to construct the Phase 3 Trail Segments over, on and across the ▇▇▇▇▇▇▇▇▇ Property on or before April 1, 2024. If the City does not acquire the necessary rights and/or interests on or before April 1, 2024, the Phase 3 Trail Design Deadline shall be extended until June 1, 2025.
