Transaction Terms and Conditions. Amend Article Two as follows: Section 2.1 is amended by adding the following sentence to the end thereof “Any Transaction formed and effectuated pursuant to the foregoing shall be considered a ‘writing’ or ‘in writing’ and to have been ‘signed’ by each Party or otherwise binding on the Parties.” Section 2.2 is amended to delete the second comma after the words “supplements hereto),” and before “the Party” in the second sentence.
