Transfer of Ownership of Mortgaged Property Sample Clauses

The 'Transfer of Ownership of Mortgaged Property' clause defines the rules and conditions under which the ownership of a property that is subject to a mortgage can be transferred to another party. Typically, this clause requires the lender's consent before the borrower can sell or otherwise transfer the property, and may specify procedures for notifying the lender or settling the outstanding mortgage balance. Its core function is to protect the lender's security interest in the property by ensuring that ownership changes do not occur without their knowledge or approval, thereby reducing the risk of default or loss of collateral.
