Common use of Transitional Provision Clause in Contracts

Transitional Provision. Subject to the satisfaction of the conditions contained in Sections 6.1 and 6.2, from and after the Closing Date, all Existing Letters of Credit shall be deemed to have been issued pursuant to this Section 2.2 and to be Letters of Credit issued and outstanding hereunder and shall be subject to and governed by the terms, provisions and conditions hereof.

Subject to the satisfaction of the conditions contained in Sections 6.1 5.1, 5.2, 5.3 and 6.25.4, from and after the Effective Date each of the letters of credit identified on Schedule 3.2 hereto and issued for the account of the Company and its Subsidiaries pursuant to the Existing Credit Agreement (or deemed to be issued as of the Closing Date, all Date under the Existing Letters of Credit Agreement) shall be deemed to have been issued pursuant to this Section 2.2 and to be Letters of Credit issued and outstanding hereunder and shall be subject pursuant to and governed by the terms, provisions and conditions hereofthis Article III.
