TRANSMISSION OF TRAFFIC TO THIRD PARTIES. 38.1 SBC-13STATE will provide LEVEL 3 with transit service in accordance with the terms and conditions of Appendix Interconnection Trunking Requirements (ITR). LEVEL 3 agrees to use reasonable efforts to enter into agreements with Third Party carriers that exchange traffic with LEVEL 3 pursuant to the terms and conditions of Appendix ITR. Subject to the requirements of Appendix ITR, SBC-13STATE shall provide at least two months’ notice in writing prior to ceasing to provide transit service.
