Common use of Transport of Local Traffic Clause in Contracts

Transport of Local Traffic. As negotiated between the Parties, the exchange of local traffic between the Parties may occur in several ways: 5.3.2.1 While the Parties anticipate the use of two way trunks for the delivery of local traffic, either Party may elect to provision its own one-way trunks for delivery of local traffic to be terminated on the other Party’s network. 5.3.2.2 The Parties may elect to purchase transport services from each other or from a third party. Such transport delivers the originating Party’s local traffic to the terminating Party’s end office or tandem for call termination. Transport may be purchased as either tandem switched transport or direct trunk transport. 5.3.2.3 Based on forecasted traffic at NewPath’s busy hour in CCS, where there is a DS1’s worth of traffic (512 CCS) between the NewPath switch and a USWC end office, the traffic will be moved to a dedicated (i.e., direct) trunk group from the NewPath switch directly to the USWC end office. To the extent that NewPath has established a Collocation arrangement at a USWC end office location, and has available capacity, the Parties agree that NewPath shall provide two-way direct trunk facilities, when required, from that end office to the NewPath switch. In all other cases, the direct facility may be provisioned by USWC or NewPath or a third party. If both NewPath and USWC desire to provision the facility and cannot otherwise agree, the Parties may agree to resolve the dispute through the submission of competitive bids.
