Transportation Operations. In the event of a spill, leak or loss of Sludge or Non-Sludge Residuals during transit not caused by Uncontrollable Circumstances or Borough Breach, the Company shall immediately arrange for the clean-up and transportation of the material to the Disposal Site at the Company’s sole cost and expense, pay any resulting fines, assessments, penalties or damages resulting therefrom, and indemnify, defend and hold harmless the Borough in accordance with the procedures provided in Section 10.2 hereof from all Loss- and-Expense resulting therefrom.
