Common use of Trash and Recycling Clause in Contracts

Trash and Recycling. Tenants must dispose of trash and recyclable materials properly. All trash and recycling containers must be supplied by Tenants and properly placed and maintained during the Term. Tenants shall not allow any trash and recyclable materials to be deposited or permitted to stand on the exterior of any building or within the common areas. Tenants are solely responsible for any extermination charges due to non-compliance with this section. Use, storage and placement of containers must comply with City of Philadelphia ordinances. Any fines affecting the Property issued by the City of Philadelphia for non-compliance with trash and recycling ordinances are the sole responsibility of Tenants. For multi-unit housing, if the offending party or parties are not clearly identified among the units, fines will be split equally between the units. Landlord and MK Management are not responsible for trash and recycling disposal. Tenants are encouraged to report trash related issues, including those related to adjacent vacant lots or abandoned properties, to the Philly311 contact center through its web application. Further, Tenants are not permitted to throw trash or any other debris over all wall or partition or onto another owner’s property.
